By accessing or using the KONG mobile application or website (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you may not use the Service.
KONG is a Miami nightlife platform that allows users to discover events, purchase tickets, reserve VIP tables, join guestlists, and connect with event organizers and venues. The Service is operated by KONG.
You must be at least 18 years old (or the legal age in your jurisdiction, whichever is higher) to use the Service. Individual events, venues, or experiences may require a higher minimum age, including 21+ where alcohol is served. Those listing-specific restrictions remain enforceable at entry.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Ticket purchases are subject to the event organizer's disclosed refund policy and mandatory consumer rights. KONG connects buyers with independent organizers and acts as their limited payment collection agent, subject to its obligations under applicable law. Refunds for cancelled or rescheduled events are handled in accordance with the event organizer's refund policy and applicable law.
For future ticket sales under marketplace version 2026-09-10-organizer-all-in-v2, the displayed ALL IN price is the total the buyer pays. No fees or tax are added at checkout. The organizer bears and authorizes deductions for the disclosed KONG commission, actual Stripe processing fees and agreed promoter commissions. The organizer is responsible for applicable included sales taxes. Applicable tax is separately stated in the purchase breakdown and receipt without increasing the displayed total. KONG commission is accounted for separately from tax and organizer proceeds. Completed purchases are not repriced.
Organizers are responsible for determining taxability, obtaining required registrations, providing accurate business and event-location information, and collecting, reporting and remitting the correct tax amounts to the relevant tax authorities. Tax collected for which the organizer is responsible is paid to the organizer together with the applicable sale proceeds; the organizer must file the required returns and pay those taxes, subject to applicable law. Where mandatory law requires KONG to calculate, collect, withhold, report or remit tax, KONG must perform those duties. Tax is a liability, not KONG revenue or part of the KONG fee. KONG only retains and remits tax where legally required. Withdrawals depend on settled cash, seller balances, tax liabilities, refunds and disputes.
Florida is the initial rollout. Event location, county, exemptions and required registrations must be verified before collection is enabled. A Stripe account or accepting these terms does not establish a tax registration or activate collection, filing or remittance. No automatic Stripe Tax filing is promised.
Organizers must expressly accept the applicable marketplace terms version. KONG records the accepted version, time and IP address. Prior acceptance does not accept a new version. Refunds and fee adjustments remain subject to the applicable policy and mandatory law; nothing limits statutory refund or card-dispute rights.
By opting in to receive SMS messages from a KONG event organizer (via the optional checkbox at ticket checkout), you agree to receive recurring promotional and informational text messages from that organizer about their events.

You agree not to use the Service to: (a) violate any applicable law; (b) infringe on the rights of others; (c) transmit harmful or malicious code; (d) attempt to gain unauthorized access to the Service; or (e) engage in any activity that disrupts or interferes with the Service.
All content on the Service, including text, graphics, logos, and software, is the property of KONG or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
To the maximum extent permitted by law, KONG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
You agree to indemnify and hold harmless KONG, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated terms within the app or by sending you a notification. Organizers must expressly accept updated marketplace terms; prior acceptance does not constitute acceptance of the new version.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
