By accessing or using the KONG mobile application or website (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you may not use the Service.
KONG is a Miami nightlife platform that allows users to discover events, purchase tickets, reserve VIP tables, join guestlists, and connect with event organizers and venues. The Service is operated by KONG.
You must be at least 21 years of age to use the Service. By creating an account, you represent that you are 21 or older and have the legal capacity to enter into these terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
All ticket sales are final unless otherwise stated by the event organizer. KONG acts as a marketplace facilitator. Refunds for cancelled or rescheduled events are handled in accordance with the event organizer's refund policy and applicable law.
By opting in to receive SMS messages from a KONG event organizer (via the optional checkbox at ticket checkout), you agree to receive recurring promotional and informational text messages from that organizer about their events.

You agree not to use the Service to: (a) violate any applicable law; (b) infringe on the rights of others; (c) transmit harmful or malicious code; (d) attempt to gain unauthorized access to the Service; or (e) engage in any activity that disrupts or interferes with the Service.
All content on the Service, including text, graphics, logos, and software, is the property of KONG or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
To the maximum extent permitted by law, KONG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
You agree to indemnify and hold harmless KONG, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated terms within the app or by sending you a notification. Your continued use of the Service after any changes indicates your acceptance of the updated terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
