KONG - Miami Nightlife Platform

1. Information We Collect

When you use KONG, we may collect the following information:

• Account Information: Name, email address, phone number, and profile photo when you create an account.
• Location Data: With your permission, we collect your device location only while you are actively using the app to show nearby venues, events, and provide directions. KONG does not track your location in the background or when the app is closed.
• Camera & Photo Library: With your permission, we access your camera to scan QR codes for venue check-in and guestlist access, and your photo library so you can set a profile picture, attach images to messages, and upload photos for listings or event flyers. Photos are uploaded only when you explicitly choose them.
• Microphone: With your permission, we access your microphone only when you record a voice message for the KONG AI assistant. We do not record audio in the background.
• Contacts: With your permission, we access your contacts only when you choose to invite friends to an event or guestlist. We use contacts strictly to display them inside the invite picker; we do not upload your address book to our servers.
• Notifications: With your permission, we send push notifications about upcoming events, VIP table confirmations, and exclusive offers from venues you follow.
• Usage Data: Information about how you interact with the app, including pages visited, features used, and search queries.
• Device Information: Device type, operating system, and unique device identifiers for app functionality and analytics.
• Payment Information: When making purchases, payment details are processed securely through our payment provider (Stripe). We do not store full credit card numbers.
• Communications: Messages sent through the in-app messaging feature.

2. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve the KONG app and its features.
• Personalize your experience with relevant venue and event recommendations.
• Process transactions and send related information (confirmations, receipts).
• Send notifications about events, bookings, and updates you have opted into.
• Respond to your comments, questions, and customer service requests.
• Monitor and analyze trends, usage, and activities to improve the app.
• Detect, investigate, and prevent fraudulent transactions and other illegal activities.

3. Information Sharing

We do not sell your personal information. We may share your information in the following circumstances:

• Service Providers: With third-party vendors who perform services on our behalf (payment processing, analytics, email delivery).
• Event Organizers & Venues: When you join a guestlist or purchase tickets, relevant information may be shared with the event organizer or venue for entry purposes.
• Legal Requirements: When required by law, regulation, or legal process.
• With Your Consent: When you have given us explicit permission to share your information.

4. Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. This includes encryption of data in transit and at rest, secure authentication protocols, and regular security assessments.

5. Your Rights & Choices

You have the following rights regarding your data:

• Access & Update: You can access and update your account information through the app settings.
• Location: You can disable location sharing through your device settings at any time.
• Notifications: You can manage push notification preferences in the app settings.
• Account Deletion: You can request deletion of your account and associated data by contacting us.
• Data Portability: You can request a copy of your personal data in a portable format.

6. Children's Privacy

KONG is not intended for users under the age of 21. We do not knowingly collect personal information from individuals under 21. If we become aware that we have collected personal information from someone under 21, we will take steps to delete that information.

7. Third-Party Services

Our app may contain links to third-party websites or services. We are not responsible for the privacy practices of these external services. We encourage you to review their privacy policies before providing any personal information.

8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated policy within the app or by sending you a notification. Your continued use of KONG after any changes indicates your acceptance of the updated policy.

9. SMS / Text Message Communications

KONG offers an optional SMS messaging service that allows event organizers and venues to send promotional messages and event invitations directly to customers who have purchased tickets through the platform.

Opt-In: Users may opt-in to receive SMS marketing messages from a specific event organizer at the time of ticket purchase. This is done through an unchecked checkbox during the checkout process. By checking this box, you expressly consent to receive recurring promotional and informational text messages from the selected organizer about their upcoming events. Consent is not a condition of purchase.

Message Frequency: Message frequency varies by organizer, typically 1 to 4 messages per month per organizer you have opted-in to.

Message and Data Rates: Standard message and data rates may apply, as charged by your mobile carrier.

Opt-Out: You can opt-out at any time by replying STOP to any message you receive. You will receive a one-time opt-out confirmation message. You can also opt-out via your account settings in the KONG mobile app.

Supported Carriers: Major U.S. carriers are supported (AT&T, Verizon, T-Mobile, Sprint, US Cellular, and others). Carriers are not liable for delayed or undelivered messages.

Information Sharing: Your phone number and SMS preferences are shared only with the specific event organizer(s) you have opted-in to, solely for the purpose of sending you the messages you consented to receive. We do not sell, rent, or share your mobile information with third parties or affiliates for marketing or promotional purposes. All other data sharing follows the rules described in section 3 above.

Compliance: Our SMS program complies with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and all applicable state and federal regulations.
